Connecticut Bars Pay History Inquiries

Connecticut has enacted legislation (House Bill 5386) that will prohibit employers from asking applicants about their pay history. The law generally prohibits employers from inquiring about an applicant’s pay history, unless the prospective employee has voluntarily disclosed the information.

The ban doesn’t apply to any action taken by an employer pursuant to a federal or state law that specifically authorizes the verification of pay history for employment purposes. Additionally, the law permits employers to ask about the elements of a prospective employee’s previous pay packages (such as stock options), as long as the employer doesn’t ask about the value.

Coverage: Employers with employees in Connecticut.

Effective: January 1, 2019

Action Required: In anticipation of the effective date, Connecticut employers should review and modify their employment applications, interview protocols, and verification policies to exclude inquiries that relate to a job applicant’s salary history.
