Hawaii to Require that Job Listings Disclose Pay Information

Hawaii has enacted legislation (Senate Bill 1057), which requires employers with 50 or more employees to disclose in job listings the hourly rate or salary range for the position. Senate Bill 1057 also broadens the state’s equal pay law. The changes take effect Jan. 1, 2024.

Hawaii enacts minimum wage legislation

On June 24, 2022, Hawaii Governor David Ige signed into law HB 2510 which incrementally increases the state’s minimum wage.  The current minimum wage in Hawaii is $10.10 per hour.  The minimum cash wage is $9.35 but only if an employee earns $7.00 more than the minimum wage through tips and wages.

Employers Cannot Consider Prior Salary History under the Federal Equal Pay Act

On April 9, 2018, the U.S. Court of Appeals for the Ninth Circuit held in Rizo v. Yovino that prior salary alone—or in combination with other factors—cannot justify a wage differential between male and female employees under the Equal Pay Act. No. 16-15372 (Apr. 9, 2018). This Rizo decision overturns a 2017 Ninth Circuit decision, which held that prior salary was a permissible “factor other than sex” under the Equal Pay Act. The Rizo decision is now the federal law across the Ninth Circuit jurisdiction - Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.
