Maine restricts use of social security numbers

Overview:  Maine has enacted legislation (Legislative Document 305) that will generally prohibit employers from seeking Social Security Numbers on employment application forms.

Effective Date: January 1, 2020

Details:

Effective January 1, 2020, employers are prohibited from asking applicants for their Social Security Number on a job application or during the application process, unless it is for the purposes of drug testing in accordance with state law and background checks.

Legislative Document 305 doesn’t prohibit employers from asking for Social Security Numbers after the individual is hired.

 

Action Required:  Maine employers should ensure review application forms and hiring procedures to ensure compliance with Legislative Document 305.
