Maryland Prohibits Certain Supervisor-Employee Committees, Adds Penalties for Youth Labor Violations

Maryland has enacted legislation prohibiting employers from allowing the formation of certain supervisor-employee committees in the workplace. The law also gives the state’s Labor Commissioner the authority to impose penalties on employers that violate state rules governing the employment of minors.

Maine to Require Pay Disclosure in Job Postings

Maine has enacted legislation that generally requires employers with 10 or more employees to ensure that job postings include a statement listing the prospective pay range the employer will offer a successful applicant. Covered employers must also provide an employee’s pay range upon request.

Chicago Amends Rules for ‘Fair Workweek Ordinance’

The City of Chicago has updated the rules for its Fair Workweek Ordinance. The rules take effect June 1, 2026. The rules clarify and define various aspects of the ordinance, including scheduling requirements, predictability pay, advance notice, offering extra hours, and more.

Alabama Creates Tax Credit for Employers that Provide Paid Leave for Organ Donation

Alabama has enacted legislation creating a tax credit for employers that provide paid time off for organ donation. To be eligible for the tax credit, employers must adopt a written policy containing certain elements.

Federal Court Blocks TPS for Yemen

On May 1, 2026 a U.S. District Court blocked the termination of TPS for Yemen. Yemeni TPS holders remain authorized to work while the lawsuit continues.

The Department of Homeland Security (DHS) announced termination of Temporary Protected Status (TPS) for six countries. Courts have blocked termination for these countries.

Treasury Publishes Final Rules Listing Occupations that Qualify for No Tax on Tips Deduction and Provides Additional Guidance on Qualified Tips

The U.S. Department of the Treasury (Treasury) has finalized regulations  under the new “No Tax on Tips” deduction, identifying which occupations are eligible for the new deduction because they customarily and regularly received tips as of Dec. 31, 2024, and defining “qualified tips.”   The Listed Occupations include corresponding Treasury Tipped Occupation Codes (TTOCs) which employers must report on 2026 tax forms.  The tax regulations do not alter the Fair Labor Standards Act (FLSA) wage and hour rules or tip credit eligibility.

ICE Updates Form I-9 Enforcement Guidance

U.S. Immigration and Customs Enforcement has updated guidance on how it will view Form I-9 errors. The list of errors includes items that that are now reclassified as “substantive” errors and therefore subject to immediate penalties.

Washington Prohibits Mandatory Employee Microchipping

The State of Washington has enacted legislation (House Bill 2303), which prohibits an employer from requiring an employee or applicant to be microchipped. House Bill 2303 takes effect June 11, 2026.

Virginia to Add Heat Illness Prevention Requirements

Virginia has enacted legislation (House Bill 1092), which will require employers to implement heat illness prevention plans under state law.
