Colorado Clarifies Protections for Gender Expression

Colorado has enacted legislation that clarifies the state’s prohibition on discrimination based on an individual’s gender expression. The clarification is a result of the enactment of House Bill 25-1312 and is effective immediately.

Colorado Amends Rules on Deductions, Broadens Retaliation Protections

Colorado has enacted legislation that amends rules on payroll deductions and expands retaliation protections under the state’s wage and hour and youth employment laws. The law (House Bill 25-1001) takes effect August 6, 2025.

Colorado Amends Paid Family Leave Program

 Colorado has enacted legislation that extends the maximum duration of paid family and medical leave for a parent who has a child receiving inpatient care in a neonatal intensive care unit.  The change applies to claims for benefits arising on or after Jan. 1, 2026.


The legislation also reduces the premiums collected from each employee used to finance the program starting on Jan.  1, 2026. 

Colorado - Boulder City, CO enacts minimum wage

The Boulder City, CO Council has enacted an ordinance that creates a minimum wage higher than the Colorado state minimum wage.

Colorado Supreme Court Rules Holiday Incentive Pay Must be Included When Calculating Overtime Payments

The Colorado Supreme Court issued a decision, finding that the “regular rate of pay” under Colorado law includes holiday incentive pay for purposes of calculating overtime. The Court’s decision significantly impacts how Colorado employers calculate overtime rates for employees not exempt from state overtime requirements.   

Colorado Expands Protections from Hairstyle Discrimination

Colorado has enacted legislation that expressly prohibits employers from discriminating against individuals because of hair length commonly or historically associated with race. The law (House Bill 24-1451) became effective immediately on June 3, 2024.

Colorado Adds Protections for Living Organ Donors

Colorado has enacted legislation that prohibits employers from taking adverse action against an employee because they are a living organ donor. The law (House Bill 24-1132) became effective immediately on June 3, 2024.

Colorado Enacts Law Establishing Guardrails against Discrimination from AI Use

Colorado has enacted legislation that establishes guardrails against discrimination for employers that deploy certain Artificial Intelligence (AI) systems. The law (Senate Bill 24-205) takes effect Feb. 1, 2026.

Colorado Provides Guidance on Amended Pay Transparency Rules

The Colorado Department of Labor and Employment (CDLE) recently issued guidance on changes to the state’s pay transparency rules.

Boulder County, Colorado Enacts Minimum Wage

The Boulder County, Colorado, Board of County Commissioners adopted Ordinance 2023-4 ,which establishes a new local minimum wage starting Jan. 1, 2024.
