New EEO-1 Report

Summary: The EEOC will now require employers with 100 or more employees to include pay data and hours worked in their EEO-1 annual report. 


Action Required: Starting January 1, 2017 clients with 100 or more employees must input hours worked when processing payroll with ADP TotalSource® to enable ADP TotalSource to accurately file an EEO-1 report on behalf of the client.

As discussed in a previous alert, the new EEO-1 report for employers with at least 100 employees will include employees’ W-2 earnings data and actual hours worked, with the first set of reports containing this additional information to be filed in March of 2018.  This means there will be no EEO-1 reports filed during the September 2017 reporting cycle.  

The wage data provided will be as reflected on the employee’s W-2 from the prior year (calendar year 2017). The hours worked to be reported will be those for the entire calendar year ending the December 31 prior to the reporting deadline.


Practical Impact: If you are an employer with 100 or more employees and are required to file an EEO-1 and are not currently reporting hours worked to ADP (for example, you pay by the piece, by the mile, by the route or you have commissioned sales people), you should take steps now to discuss with your Payroll Representative the most efficient way for you to track and report hours. You might also consider utilizing one of ADP’s time and labor management tools.
