Final Fair Labor Standards Act Regulations – Navigator OT Updated

Executive Summary

Overview:  We are pleased to announce that our Navigator OT application (in addition to OT Cost Estimator) has been updated to conform to the final Fair Labor Standards Act Regulations (the regulations are effective December 1, 2016).  Please review the details below for more information.   A copy of the Navigator OT and OT Cost Estimator Welcome Kit describing these applications is also available on FormSource in the Payroll Section.


The Details
Users of the application now have the option to review positions under the pre-2016 regulations and under the 2016 regulations by accessing these distinct application versions directly from the user dashboard.

The following changes were also made to the new version of the application:

  • The job duties screen now allows a user to enter single percentages instead of ranges, making correctly totaling percentages easier.
  • The NAICS code field has been deleted.
  • A "Profession-Specific Exemptions" warning appears on the bottom of the results page notifying end-users that Navigator OT does not review profession specific exemption tests (e.g. for doctors, lawyers and teachers).  Doctors, lawyers, and teachers generally satisfy the requirements for the learned professional exemption but they are not required under the FLSA to be paid on a salary basis.
  • If the evaluation task is assigned to a manager, the reviewing manager will no longer automatically receive the evaluation results (only the credentialed user initiating the review can access evaluation results).
