North Dakota Strengthens Pregnancy Protections

The North Dakota Human Rights Act prohibits employers of all sizes from failing or refusing to make reasonable accommodations for an otherwise qualified individual with a physical or mental disability because that individual is pregnant. 

North Dakota has enacted House Bill 1450, which takes effect August 1, 2023 and clarifies that “pregnant” includes pregnancy, childbirth and related medical conditions.

North Dakota expands COVID-19 vaccination exemptions

North Dakota has enacted legislation (HB 1511) that requires private employers to allow certain employee exemptions from the COVID-19 vaccine. The law is effective from Nov.15, 2021 to Aug.1, 2023, unless extended.

North Dakota approves vaccination protections

North Dakota Governor Doug Burgum has signed legislation (HB 1465) that addresses rules pertaining to vaccination status. HB 1465 is effective immediately.

Seven States Pass New Marijuana Laws on Election Day

Seven (7) states have joined the growing list of states legalizing the use of marijuana for medicinal and/or recreational purposes.  Arkansas, California, Florida, Maine, Massachusetts, Nevada, and North Dakota passed new marijuana laws on election day, bringing the total states (plus the District of Columbia) with medical marijuana laws to 28 and the total states (plus the District of Columbia) with recreational marijuana laws to eight (8).

This session the North Dakota Legislature enacted laws pertaining to employer reimbursement for tools, pregnancy discrimination, and rules governing forfeiture of PTO.

The North Dakota state poster has been updated with information regarding paid time off. Limitations on accrued paid time off was also updated and "Pregnancy" has been added as a protected category.
