Maine Employers Must Provide Sexual Harassment Policy Annually

Maine law requires employers to annually provide their employees with notice of the employer’s sexual harassment policy. The employer’s policy must contain, for example, the definition of harassment (with examples), the employer’s internal complaint mechanism, the Maine Human Rights Commission’s complaint process, and an anti-retaliation statement.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Maine Enacts Regulatory Structure for Adult Use of Marijuana

On May 2, 2018, the Maine Legislature overrode Governor Paul LePage’s veto and enacted An Act to Implement a Regulatory Structure for Adult Use of Marijuana (“the Adult Use Act”). The Adult Use Act deletes the anti-discrimination provision that prohibited Maine employers from refusing to employ or otherwise penalizing any person age 21 or older based on that person’s “consuming marijuana outside the . . . employer’s . . . property.”

Maine Recreational Marijuana Law Limits Workplace Drug Testing As Well As Disciplinary Consequences Imposed By Employers

A provision of Maine’s recreational marijuana law prohibits employers from testing for marijuana for pre-employment purposes and affects employers with employees who are subject to federal drug and alcohol testing regulations, as well as employers who are exempt from complying with Maine’s drug testing law.

Minimum Wage Update for Missouri and Minimum Salary Threshold Update for Alaska, California, Colorado, Maine and New York

In addition to the states identified in the December 14, 2017, Insights & Solution newsletter, Missouri will see an increase to its minimum wage come January 1, 2018. Alaska, California, Colorado, New York and Maine will also see increases to the minimum salary threshold for employee exemptions.
