Mississippi Expands Protections for Military Service Members or Veterans While Training

Mississippi provides employment protections to members of the armed forces and veterans who are called to perform duties or receive training. Specifically, members of any reserve component of the United States armed forces or qualified former service members performing duties or receiving training with the United States armed forces, the state of Mississippi, or any other state (including active state duty, state-training duty or any other military duty authorized under Title 10 or Title 32 of the United States Code) must be restored to their previous or similar employment position with the same status, pay, and seniority upon return from duty or training. To be eligible for reinstatement, the service member must provide evidence that the duty or training was completed satisfactorily, and must still be qualified to perform the duties of his or her employment position.

These protections do not apply to temporary employment positions.

Coverage: Employers with employees in Mississippi.

Effective: July 1, 2018

Action Required: You should familiarize yourself with the state’s expanded requirements and, if necessary, revise your leave of absence and reemployment policies in accordance with the amended law.
