New Mexico repeals youth minimum wage

New Mexico has enacted legislation (Senate Bill 35) that will require employers to pay high school workers at least the minimum wage per hour.

Background:

Previously, New Mexico allowed employers to pay high school students (those who were regularly enrolled in secondary school and working after school or when school was not in session) at least $8.50 per hour.

Senate Bill 35:

Beginning June 18, 2021Senate Bill 35 requires employers to pay high school workers at a rate that meets or exceeds the minimum wage (currently $10.50 per hour at the state level). Note: There are higher minimum wage rates in the City of Albuquerque, Bernalillo County, the City of Las Cruces, the City of Santa Fe, and Santa Fe County.

Compliance Recommendations:

New Mexico employers should ensure compliance with the new minimum wage requirements for high school workers. Please contact your dedicated service professional with any questions.
