Oregon has enacted legislation (Senate Bill 569) that prohibits an employer from requiring an employee or prospective employee to possess or present a valid driver's license as a condition of employment or continued employment. Senate Bill 569 takes effect on January 1, 2022.
Employer Restrictions:
Senate Bill 569 prohibits employers from taking the following actions against an employee or candidate:
- Requiring them to possess or present a valid driver license unless the ability to legally drive is an essential function of the job or is related to a legitimate business purpose as a condition for, or continuation of, employment; and
- Refusing to accept, as an alternative to a driver's license, other identification documents that the United States Citizenship and Immigration Services (USCIS) allows to be used to verify identity and work authorization (see Form I-9's list of acceptable documents).
Employers may accept a driver's license as identification if an employee or candidate voluntarily offers it.
