Reminder - Employers Must File EEO-1 Report

Executive Summary

Overview:  The deadline is approaching for many employers to report to the federal government the race/ethnicity, job category and gender composition of their workforces.

Covered Employers:  All companies that meet the following criteria are required to file the EEO-1 report annually:

  1. Subject to Title VII of the Civil Rights Act of 1964, as amended, with 100 or more employees; or
  2. Subject to Title VII of the Civil Rights Act of 1964, as amended, with fewer than 100 employees if the company is owned by or corporately affiliated with another company and the entire enterprise employs a total of 100 or more employees; or
  3. Federal government prime contractors or first-tier subcontractors subject to Executive Order 11246, as amended, with 50 or more employees and a prime contract or first-tier subcontract amounting to $50,000 or more.

Effective Date:   If you are a covered employer you must file the Employer Information Report, Form EEO-1, by September 30, 2014.


Overview of the EEO-1 Report

The EEO-1 Report is an employer-compiled report that provides the federal government with workforce profiles by gender and defined race/ethnicity groupings in defined job categories. For more information please visit http://www.eeoc.gov/eeo1survey/index.html and review the summary of requirements.

Data Collection

The EEOC strongly endorses the employee’s voluntary self-identification of race and ethnicity, rather than visual identification by employers. Visual identification or reliance on employment records is appropriate only if invitations for employees to voluntarily self-identify fail.

As a service to clients, we provide a sample voluntary self-identification form on Formsource under the New Hire section (“Equal Employment Opportunity Data Form”), which may be used in gathering EEO-1 information.

Employers should ensure that they maintain the confidentiality of this information, and to the extent possible, ensure that access to this information is limited to staff who are not involved in employment decisions. We also recommend that this form be kept separate from the employee’s personnel file.

EEO data on My ADP Resource

In addition, clients may access EEO data on My ADP Resource by following these steps:

1) Login to My ADP Resource and navigate to Reporting / HR Reports

2) Select the ’EEO Non-Fileable Information Report’ either in PDF or Excel format.

This report identifies employees with and without the necessary EEO-1 data setup on the employee record (Gender, Ethnicity or Job Category).

Finally, clients may access the HR Report, “EEO-1 Report Data,” in PDF or Excel format to gather the EEO-1 report information. Note the report itself cannot be filed with the EEOC but the data contained in the report may be used to complete the EEO-1 Report. Client administrators must have access to HR Reports to be able to view any of the EEO reports above.
