Effective January 1, 2018, North Carolina employers must pay workers employed in seasonal amusement or recreational establishments the full minimum wage rate. These employees must also be paid overtime if they work over 40 hours in a workweek.  Prior to the passage of Senate Bill 82, employers were only required to pay these employees 85% of the minimum wage rate.

Employees at seasonal food service establishments will still be covered by the previous law in 2018.

Coverage:  Employers of seasonal amusement or recreational establishments in North Carolina.

Effective:   January 1, 2018

Action Required:  You should increase the minimum hourly rate for impacted employees paid below the minimum.
