Third Circuit Says Employers Cannot Bypass Obligation to Compensate Employees for Short Rest Periods

According to the Third Circuit, refusing to compensate employees for short breaks is prohibited by the Fair Labor Standards Act. Employers must be paid for rest breaks that are twenty minutes or less in duration.
