Colorado requires notice before certain deductions from wages

Colorado has enacted legislation (Senate Bill 161) that amends the state’s wage theft law. It requires employers to provide notice to an employee before deducting from their pay for money or property the employee failed to return or repay upon termination of employment.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Minimum Wage Update for Missouri and Minimum Salary Threshold Update for Alaska, California, Colorado, Maine and New York

In addition to the states identified in the December 14, 2017, Insights & Solution newsletter, Missouri will see an increase to its minimum wage come January 1, 2018. Alaska, California, Colorado, New York and Maine will also see increases to the minimum salary threshold for employee exemptions.

Colorado Updates State Poster to Include Prohibition on Pregnancy Discrimination and Issues Pregnancy Accommodation Notice

The Colorado Civil Rights Division has updated its Anti-Discrimination Notice. "Pregnancy" is listed as a new protected class under the Employment Discrimination section of the notice.

Colorado Grants Employees Access to Personnel Files

Current employees of private sector employers in Colorado have been granted the right to inspect and obtain a copy of their personnel files at least one time per year.  Former employees have been granted the right to inspect their personnel files one time after the termination of their employment.

Colorado Repeals Affirmation Requirement

Effective August 10, 2016, Colorado employers are no longer required to complete and retain the Colorado Affirmation Form, confirming that they have examined whether a new hire is authorized to work in the United States.

New State Minimum Wage

The Division of Labor has adopted Colorado Minimum Wage Order Number 32, effective January 1, 2016 through December 31, 2016, to reflect the state minimum wage of $8.31 per hour.

Minimum Wage Update

Colorado's minimum wage was increased from $8.00 to $8.23 per hour on January 1, 2015. The state minimum wage for tipped employees increased from $4.98 to $5.21 per hour effective January 1, 2015.
