Updated: Federal Judge Blocks Florida Law Limiting Workplace Bias Trainings

Update: On March 4, 2024, a three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit affirmed the preliminary injunction discussed below. Therefore, the law continues to remain blocked. The state could appeal this decision. Impacted employers should continue to monitor developments.

A federal judge has granted a preliminary injunction blocking a Florida law that prohibits employers with 15 or more employees from subjecting an individual to training that endorses certain concepts about discrimination.

Florida Requires Certain Employers to Use E-Verify

Florida has enacted legislation (Senate Bill 1718) that requires certain employers to use E-Verify to confirm a new hire is eligible to work in the United States. The requirement takes effect July 1, 2023.

Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.
