Minimum Wage Update for Various Jurisdictions

Various jurisdictions have increased their minimum wage rates. If applicable, you must increase the pay rate for exempt and/or non-exempt employees to meet the new minimum wage. For New York, the pay rate increase is effective on or before December 31, 2018. For all other jurisdictions and federal contractors, the increase is effective on or before January 1, 2019. An updated poster is not required provided that the employer has the most recent poster already on display. If needed, employers should order a new minimum wage poster. The minimum wage rate is based on the employee’s work location.

Massachusetts Modifies Timing for Calculating Minimum Wage for Tipped Employees

Massachusetts Strengthens Protections for Pregnant Workers

In an amendment to the Massachusetts Fair Employment Practices Act, the state of Massachusetts has expressly included pregnancy as a protected characteristic and expands accommodation requirements for pregnant employees. The amended law goes into effect April 1, 2018.

Massachusetts Employers Must Engage Medical Marijuana Users in Interactive Process

The Massachusetts Supreme Judicial Court in Barbuto v. Advantage Sales & Marketing, LLC has ruled that handicapped employees, who have been prescribed medical marijuana, may be entitled to a reasonable accommodation and employers, at the very least, have an obligation to engage such employees in an interactive process to assist in making this determination.  The Court’s ruling is significant because it questions the validity of zero-tolerance drug policies as applied to medical marijuana users in Massachusetts.

Seven States Pass New Marijuana Laws on Election Day

Seven (7) states have joined the growing list of states legalizing the use of marijuana for medicinal and/or recreational purposes.  Arkansas, California, Florida, Maine, Massachusetts, Nevada, and North Dakota passed new marijuana laws on election day, bringing the total states (plus the District of Columbia) with medical marijuana laws to 28 and the total states (plus the District of Columbia) with recreational marijuana laws to eight (8).

Reminder - Massachusetts Employers Must Provide Sexual Harassment Policy Annually

Massachusetts Enacts Transgender Accommodation Law

9/1/16

Effective October 1, 2016, transgender individuals in Massachusetts will have the legal right to use restrooms, changing rooms, and locker rooms that correspond to their gender identity, regardless of their assigned sex. Additionally, no place of public accommodation (that is any place that is open to and solicits the patronage of the general public) will be allowed to discriminate or advertise in a way that discriminates based on gender identity.
