Sick Leave Toolkit Updated

1/7/16

Author: Miranda Wyatt/Wednesday, January 6, 2016/Categories: Bulletin News

Our Sick Leave Toolkit, which includes Frequently Asked Questions (FAQs) and model sick leave policies for jurisdictions with sick leave laws, has been updated as follows:

Changes Impacting FAQs (question numbers are noted in parentheses)

  • San Francisco, CA— Government guidance issued (25).

  • MA— The attorney general has published a written notice of rights (21) and FAQs (25).

  • Jersey City, NJ— Adopted an amendment expanding employer coverage and penalties  (2, 5, 6, 7 14,16,17,19, 24).

  • Elizabeth, NJ— FAQs added.

  • Newark, NJ— A link to new poster (21) and a link to government guidance (25) have been added.

  • New Brunswick, NJ— A link to government issued FAQs has been added.  Toolkit FAQs will be released in the future.

  • OR—  Clarified caps on accrual (17) and a link to a new government issued employee notice template  has been added (21).

  • Pittsburgh, PA— A note was added indicating that this ordinance has been struck down by a court of law (1).  It is unknown whether the city will appeal the ruling.  Therefore FAQs were not deleted. Unless decision is appealed and reversed, employers doing business in Pittsburgh will not need to comply with the Paid Sick Leave Ordinance or amend their policies to do so.

New Policies or Updates:

  • MA— Safe Harbor information deleted from notes section (since the safe harbor provision expired on 12/31/15).

  • OR— Added model policy.

  • Pittsburgh, PA— Added model policy (also see note above regarding court ruling).

  • Elizabeth, NJ— a model policy will be released in the future.

  • New Brunswick, NJ— a model policy will be released in the future.

The toolkit is available on FormSource in the Leave and Return to Work section.
