California - Legislation to Reform California’ s Labor Code Private Attorneys General Act (PAGA)

Under California’s unique Private Attorneys General Act of 2004 (PAGA), an aggrieved employee is permitted to not only bring their own civil action or a class action against an employer to seek damages for alleged wrongdoings, but is also deputized to step into the shoes of the Labor Commissioner and pursue penalties for alleged violations of the Labor Code on behalf of the Labor Workforce Development Agency (LWDA).

California Health Care Worker Minimum Wage Delayed Again

The minimum wage for health care workers in California has been delayed from July 1, 2024 to at least October 15, 2024. Originally, the minimum wage was supposed to take effect June 1, 2024, but it has now been delayed twice.

California OSHA Clarifies COVID-19 Rules That Are in Effect

The California Division of Occupational Safety and Health (Cal/OSHA) has clarified that the State Public Health Officer Order dated January 9, 2024 remains in place and continues to impact Cal/OSHA’s COVID-19 Prevention Non-Emergency Standards in particular with respect to isolation of COVID-19 cases.

California Minimum Wage Increase for Healthcare Workers Delayed to July 1, 2024

On May 31, 2024, the Governor of California signed into law (Senate Bill 828) which delays the implementation of California's health care worker minimum wage law by one month from June 1, 2024 to July 1, 2024. The original law required covered health care employees to be paid a minimum of between $18 and $23 per hour depending on the type of facility between June 1, 2024 and May 31, 2025.

California - Reminder: California Workplace Violence Prevention Requirements Take Effect Soon

Many employers in California must implement an effective written plan and take certain other actions to prevent workplace violence by July 1, 2024. The requirements are a result of the enactment of Senate Bill 553.

California - Los Angeles County Enacts ‘Fair Chance’ Ordinance

Los Angeles County, California has enacted an ordinance that will impose various obligations on covered employers regarding the criminal histories of applicants and employees. The ordinance applies to only the unincorporated areas of Los Angeles County and takes effect Sept.  3, 2024.

California Issues Guidance on Fast Food Minimum Wage; New Legislation Expands Exemptions

The California Department of Industrial Relations has released guidance on a new law that entitles certain fast food restaurant workers to a minimum wage of $20 per hour beginning April 1, 2024. The state has also enacted legislation that expands the exemptions from the law effective immediately.

Reminder: California Fast Food Workers’ Minimum Wage Increases April 1

Effective April 1, 2024, fast food restaurant workers in California working at a “national fast-food chain” establishment must be paid a minimum of $20 per hour. The change is a result of legislation (Assembly Bill 1228) that was enacted in 2023.

California Updates Guidance & Resources for Pay Data Reporting, Opens Portal

California’s Civil Rights Division (CRD) has released updated frequently asked questions, templates, and a user guide for the 2023 pay data reporting period for employers with 100 or more employees. Employers must use the CRD’s online pay data reporting portal to submit their annual reports. The portal is open. The reporting deadline for 2023 is May 8, 2024.
