Delaware to Require Pay Disclosure in Job Postings

Delaware has enacted legislation that will require employers with more than 25 employees to include certain information about compensation and benefits in both internal and external postings of job opportunities. The law takes effect two years after enactment, which took place on Sept. 26, 2025.

Delaware Expands Anti-Bias Law

Delaware has enacted legislation that prohibits employers from discriminating against individuals on the basis of their military status. The change is a result of the enactment of House Substitute 1 and took effect immediately on July 23, 2025.

Delaware Issues Regulations, Guidance on Paid Family Leave Program

The Delaware Department of Labor has issued guidance and regulations to help implement the state’s Paid Leave (Family and Medical Leave Insurance Program). The program will be funded through payroll contributions paid by covered employers and employees.

Delaware prohibits employers from seeking age-related info

Delaware has enacted legislation (Senate Bill 211) that expressly prohibits employers from asking applicants age-related questions on an initial application. Senate Bill 211 is effective immediately.

Delaware Employers Will No Longer Be Able to Ask Applicants about Their Compensation History

In an effort to reduce pay gaps between genders, Delaware has enacted a pay history inquiry ban that prohibits employers from screening job applicants based on their salary history and asking a current or former employer about an applicant’s compensation history.
