Maine Announces Wage Thresholds for 2024

The Maine Department of Labor (DOL) has announced the state’s minimum salary threshold for exempting a worker from overtime pay for 2024.

The Details:

Starting Jan. 1, 2024, the new minimum salary threshold to exempt a worker from overtime pay is $816.35 per week, or $42,450.20 per year.

In its announcement, the DOL made clear:

This is only one of the factors used in determining whether a worker is exempt from overtime pay under federal or state law. An individual can earn more than the minimum salary threshold and still be eligible for overtime. The duties of each worker must be considered as part of this analysis.”

Next Steps:

 

Prior to Jan. 1, 2024, Maine employers should evaluate whether workers that currently qualify as exempt employees (e.g.; executive, professional, administrative) will earn the new minimum salary to remain exempt from overtime pay.  If not, employers must either increase the employee’s salary or reclassify the employee as non-exempt and pay overtime when working in excess of 40 hours per week.
