Colorado employee withholding certificate update

Back in November 2021, the Colorado Department of Revenue issued a new employee withholding certificate, Colorado Form DR 0004.  ADP® is in the process of updating its payroll systems to accept employee elections submitted on Form DR 0004.  This update will take effect July 22, 2022. As part of the system update to enable use of Form DR 0004, ADP will use employees’ federal marital status for Colorado income tax withholding and will not allow employees to elect a different marital status for Colorado. 

California Supreme Court rules missed break payments are wages

In a recent case (Naranjo v. Spectrum Security Services Inc.), the California Supreme Court has ruled that the extra pay an employer must pay an employee if the employee works during their meal break constitutes wages for purposes of California’s final pay and itemized wage statement requirements.     This means that employers must report these payments on wage statements and must ensure that these payments are timely paid to employees. The failure to do so can lead to significant penalties.

California amends COVID-19 prevention rules for third time

The California Division of Occupational Safety and Health (Cal/OSHA) has revised emergency rules for protecting workers from COVID-19. The emergency rules became effective on May 6, 2022 and will remain in effect through December 31, 2022.

Colorado provides new employee withholding certificate

The Colorado Department of Revenue (DOR) has released a new employee withholding certificate known as DR 0004. Prior to the DR 0004 release, Colorado did not provide a state form and the federal Form W-4 was used to calculate state tax withholding.  ADP is actively working to complete development necessary to help support clients when an employee submits a DR004.  We will keep you informed of these efforts.

Washington enacts salary transparency requirements

The state of Washington has enacted legislation (Senate Bill 5671), which amends its Equal Pay and Opportunities Act to add new salary transparency requirements. Senate Bill 5671 takes effect on Jan. 1, 2023.

Virginia clarifies maximum employer fee for child support orders

Virginia has enacted legislation (HB 808) that clarifies that fee of up to a maximum of $5.00 may be charged and withheld by the employer from the employee’s wages (in addition to the amount required to be held for child support) pursuant to an income withholding order.  The purpose of the legislation was to clarify that an employer may charge a fee of less than $5.00.

HB 808 becomes effective July 1, 2022.

Utah enacts hiring legislation

Utah has enacted two pieces of legislation (Senate Bill 95 and House Bill 252), which temporarily amend certain employer hiring liabilities and add employer verification requirements. Both take effect on May 4, 2022. Senate Bill 95 is set to expire on July 1, 2025.
