Summary: On June 26, 2026, the U.S. Supreme Court lifted an injunction from a lower court that prevented the U.S. Department of Homeland Security (DHS) from terminating TPS for Haiti and Syria. The decision does not immediately terminate TPS-based employment authorization, invalidate existing employment authorization documents or create new Form I-9 reverification deadlines. Employers should await further government guidance before taking any employment-related action.
Next Steps:
· Monitor official government announcements for additional guidance and any new employment authorization expiration dates. U.S. Citizenship and Immigration Services previously indicated that the expiration date for Haiti and Syria TPS is July 1, 2026. If no additional government guidance is issued by July 1, 2026 then employers should consider consulting with legal counsel on next steps.
· Avoid terminating, suspending, reverifying, or otherwise taking employment action against affected employees based solely on the Supreme Court’s decision.
