Year End Compliance Alert Updates - Take Action Now to Avoid Penalties

Affordable Care Act (ACA) Compliance Alert Reminder In early October 2017, the compliance alert banner went live prompting Applicable Large Employers (ALEs) to complete needed steps for us to file their 1094-C and 1095-C forms on their behalf.If you are an ALE employer and you have not yet completed your acknowledgement you will continue to see this compliance alert banner on the home page of My TotalSource.  As your compliance partner, we encourage you to take action NOW to avoid potential penalties.  Penalties associated with failing to provide a 1095-C Form or providing one after the IRS deadline can be as high as $260 per form.

ACTION REQUIRED:
1.) Log-in as an Administrator on My TotalSource.
2.) Click on the “Start Now” option or “2018 ACA Reporting Tool (ART)” on the homepage.
3.) Review and complete data on all screens and tabs.
4.) Authorize ADP TotalSource to submit reports on your behalf.

That’s it! We’ll handle the rest. ADP TotalSource will: Issue the Form 1095-C to your employees and transmit the required information directly to the IRS on your behalf. Provide your employees with instructions about including the Form 1095-C with their tax return.

*If you had an average of at least 50 full-time employees (including full-time equivalents) in 2017, you are an Applicable Large Employers (ALEs) under the Affordable Care Act (ACA).

Complete your Company EEO-1 Report Questionnaire
If you had 50 or more employees on December 31, 2018 -- the EEO Snapshot date -- a compliance alert banner will appear on the home page of My TotalSource starting January 7th prompting you to complete the needed steps for us to file on your behalf. 

ACTION REQUIRED (beginning on January 7, 2019):  
1.) Log-in as an Administrator on My TotalSource.
2.) Click on the “Start Now” option on the homepage.
3.) After responding to the questions that assist in validating your company’s requirement to file, review your employees’ worksite location assignments and update as necessary.**
4.) Authorize ADP TotalSource to submit reports on your behalf. 

**If your company is required to file the EEO-1 Report AND you have multiple FEINs, log-in under each of your FEINs to review and update your employee’s worksite location assignments as necessary.

* The EEO-1 Report is a compliance survey mandated by federal statute and regulations. The survey requires company employment data to be categorized by race/ethnicity, gender and job category. The U.S. Equal Employment Opportunity Commission (EEOC) uses EEO-1 data to support civil rights enforcement and to analyze employment patterns within companies, industries or regions. The Office of Federal Contract Compliance Programs (OFCCP) system uses statistical assessment of EEO-1 data to select facilities where the likelihood of systematic discrimination is the greatest. Generally an employer is required to file and EEO-1 Report if: It employs 100 or more employees (single location or as part of an affiliated/centrally owned enterprise)It employs 50 or more employees and has a prime contract or first-tier subcontract of $50,000 or more with a federal agency is a depository of federal government funds is an issuing and paying agent for U.S. Savings Bonds and Notes
