Illinois clarifies protections against disability discrimination

Illinois has enacted legislation (House Bill 1838) that expressly prohibits employers from discriminating against applicants and employees because of their association with an individual who has a disability. House Bill 1838 takes effect January 1, 2022.

BACKGROUND:

The Illinois Human Rights Act (IHRA) prohibits discrimination and harassment against applicants and employees based on their disability and certain other protected characteristics.

HOUSE BILL 1838:

House Bill 1838 makes clear that discrimination based on disability includes unlawful discrimination against an individual because of their association with a person with a disability.

COMPLIANCE RECOMMENDATIONS:

Illinois employers should review their policies and training to ensure compliance with House Bill 1838. Please contact your dedicated service professional with any questions.
