The Driver Privacy Act of 2015 (“Act”) was enacted as part of the Fixing America’s Surface Transportation Act (H.R. 22), signed by President Obama last month. Companies that have vehicle monitoring programs should review this new law.

In 2014, President Obama issued Executive Order 13665, with the intent of promoting pay transparency and making it possible for workers and job applicants to share information about their pay and compensation without fear of discrimination.  The Department of Labor published a Final Rule implementing that order.

The U.S. Supreme Court has held that the U.S. Department of Labor (“DOL”) did not violate the Administrative Procedure Act (“APA”) when it failed to provide the public with notice and an opportunity to comment before it changes its position on the application of the Fair Labor Standards Act’s administrative exemption to loan officers, finding them newly non-exempt.
