California Issues Emergency Regulation for Electronic Submission of 300A Forms by December 31, 2018

California employers with 250 or more employees per establishment or employers with 20-249 employees in certain identified industries (which is the same as Federal OSHA) must electronically submit to the Federal OSHA website by December 31, 2018 and then each year thereafter.

California Raises Minimum Pay Requirements for Certain Exemptions for 2019

The California Department of Industrial Relations has announced an increase to the pay rates computer software employees and physicians must receive in order to be exempt from overtime. Additionally, the minimum salary required for the administrative, professional, and executive exemptions will increase at the start of the year. These new rates take effect on January 1, 2019.

DOL Eliminates Employer-Plaguing “80/20” Tip Credit Rule

As contractors start to see new scheduling letters arrive from OFCCP’s latest round of advance notification letters, OFCCP has new opportunities to demonstrate its commitment to transparency, through implementation of the Agency’s recently released Directive 2018-08: Transparency in OFCCP Compliance Activities. The Agency’s stated philosophy is that transparency should “guide OFCCP staff during every stage of the compliance evaluation, from beginning to end” and the Directive sets out the Agency’s roadmap for transparency in audits.
