Arizona makes clear that pregnancy discrimination is prohibited

Arizona has enacted legislation (House Bill 2045) that makes clear that discrimination based on pregnancy, childbirth, or related conditions is prohibited by state law.

Effective Date:

House Bill 2045 takes effect 90 days after adjournment of the state legislature. The legislature is expected to adjourn on April 24, 2020 or later. Check the status of the legislature closely to determine the exact effective date.

Background:

Under existing state law, employers with 15 or more employees are prohibited from discriminating against individuals on the basis of:

  • Race,
  • Color,
  • Religion,
  • Sex,
  • Age,
  • National origin, and
  • Disability

House Bill 2045:

House Bill 2045 clarifies that the law also prohibits discrimination on the basis of pregnancy, childbirth, and related medical conditions. The law also makes clear that employers must treat women who are affected by these conditions the same as other individuals who are similar in their ability or inability to work.

Compliance Recommendations:
