Overview: Last month, President Obama issued a memorandum to Secretary of Labor, Thomas E. Perez, directing him to “propose revisions to modernize and streamline the existing overtime regulations” with specific regard to the executive, administrative and professional employee exemptions found in Section 13 (a)(1) of the Fair Labor Standards Act (FLSA). The President’s memorandum further directs Secretary Perez to (1) Consider how the regulations could be revised to update existing protections consistent with the intent of the Act; (2) Address the changing nature of the workplace; and (3) Simplify the regulations to make them easier for both workers and businesses to understand and apply.
