South Carolina amends firearms law

South Carolina has enacted legislation (House Bill 3094) that amends its concealed weapons law. House Bill 3094 takes effect on August 15, 2021.

Overview:

House Bill 3094 allows employers to prohibit a licensed individual from carrying a concealable weapon, whether concealed or openly carried, on its business premises, within the workplace, or while the individual uses any vehicle, machinery, or equipment owned or operated by the business.

Employer Notice:

To post signage that prohibits carrying a concealable weapon, employers must:

  • Use a sign expressing the prohibition in both written language and universal sign language; and
  • Post all signs at each entrance into a building where a concealable weapon permit holder is prohibited from carrying a concealable weapon.

Employers that wish to ban concealable weapons must follow the signage requirements below:

Door sign requirements:

Requirements for signs for premises without doors:

  • Clearly visible from outside the building
  • 8" x 12" in size
  • Contain:" NO CONCEALABLE WEAPONS ALLOWED" in black one-inch tall, uppercase type, located at the bottom of the sign and centered
  • Contain the black silhouette of a handgun inside a circle 7 inches in diameter that has a diagonal line running through it at a 45 degree angle
  • Be placed between 40 and 60 inches from the bottom of the building's entrance door.
  • 36" x 48" in size
  • Contain: "NO CONCEALABLE WEAPONS ALLOWED" in black three-inch tall, uppercase type, located at the bottom of the sign and centered
  • Contain the black silhouette of a handgun inside a circle 34 inches in diameter that has a diagonal line that's two in. wide running through it at a 45 degree angle
  • Be placed between 40 and 96 inches above the ground
  • Be posted in sufficient quantities so that they're clearly visible from any point of entry
