Notice to South Carolina Worksite Employees

Many states require employers to provide newly-hired employees with mandatory notices and/or forms.  Effective immediately, employers who hire employees to work in South Carolina must provide that new-hire with the Notice to South Carolina Worksite Employee which provides employees with information on who to contact in the event of a work-related injury, as well as information on payment of wages.

Under South Carolina law employers with handbooks wishing to preserve the "at-will" employment relationship and limit the possibility of an employee handbook being deemed an employment contract should have on the first page of the handbook (e.g. the cover page) a conspicuous disclaimer stating the employment relationship is at-will.

South Carolina Enacts New Pregnancy Accommodation Requirements

The South Carolina Pregnancy Accommodations Act (the “Act”) amends the South Carolina Human Affairs Law to require employers with at least 15 employees to provide reasonable accommodations to employees for medical needs arising from pregnancy, childbirth, or other related medical conditions (including lactation), unless the employer can demonstrate the accommodation would impose an undue hardship on the operation of the business.

South Carolina Issues New Pregnancy Accommodations FAQs and Anti-Discrimination Poster

South Carolina requires lactation breaks

South Carolina has enacted House Bill 3200 also known as the South Carolina Lactation Support Act (the "Act"), which provides protections to employees who express breast milk at work. The Act takes effect July 25, 2020.

South Carolina to end remote work tax withholding temporary rules

The South Carolina Department of Revenue (DOR) has announced that effective June 30, 2022,  it will end the temporary relief regarding a business’s establishment of nexus solely because an employee is temporarily working in a different work location due to COVID-19.
