Court Postpones Termination of Temporary Protected Status for Haiti

A federal district court has postponed the Department of Homeland Security’s (DHS) decision to terminate Temporary Protected Status (TPS) for Haiti pending further court action. TPS for Haiti would have expired effective Feb. 3, 2026.

Next Steps:

While the postponement is in place, Haiti TPS beneficiaries remain in employment authorized status.

DHS is expected to provide guidance on how to identify which employment authorization documents are impacted by the court’s decision. This guidance will likely appear on the DHS website soon. DHS is also expected to appeal the court’s decision.

Employers and TPS beneficiaries should be aware that TPS policy continues to shift rapidly and remains the subject of ongoing litigation. ADP will continue to monitor and report future developments.
