Tennessee Amends E-Verify Act

The Tennessee Lawful Employment Law Act (E-Verify Act) was recently amended in an effort to minimize the compliance burden on small businesses and strengthen the authority of the Tennessee Department of Labor (TDOL) to pursue violators.  Effective January 1, 2017, private employers with at least 50 employees are required to enroll in the E-Verify program and use the system to verify employment eligibility for newly hired workers.  In addition, the amendment authorizes the TDOL to pursue employers that knowingly violate the E-Verify Act.

Tennessee Employers May Allow Concealed Weapons in the Workplace

Tennessee law now allows an individual, corporation, business entity, or government entity (collectively “entity”) to permit the concealed carry of handguns by permit holders, while still prohibiting other weapons or the open carry of firearms at the workplace. Tennessee law previously allowed an entity to prohibit possession of all weapons on its premises, including by a person authorized to carry a concealed firearm with a valid permit.

Tennessee Law Prohibits Non-Disclosure Provisions in Agreements with respect to Sexual Harassment Claims

Tennessee has enacted a law that prohibits public and private employers from requiring an employee or prospective employee from executing or renewing a non-disclosure agreement with respect to claims of sexual harassment in the workplace as a condition of employment.
