Nevada Supreme Court Clarifies Circumstances in Which Employers May Pay the Lower of the State’s Two-Tier Minimum Wages

The Nevada Supreme Court has concluded that an employer may pay the lower of the state’s two-tier minimum wage if the employer offers health insurance at a cost to the employer of the equivalent of at least an additional dollar per hour in wages, and at a cost to the employee of no more than 10 percent of the employee’s gross taxable income from the employer.

Employers Cannot Consider Prior Salary History under the Federal Equal Pay Act

On April 9, 2018, the U.S. Court of Appeals for the Ninth Circuit held in Rizo v. Yovino that prior salary alone—or in combination with other factors—cannot justify a wage differential between male and female employees under the Equal Pay Act. No. 16-15372 (Apr. 9, 2018). This Rizo decision overturns a 2017 Ninth Circuit decision, which held that prior salary was a permissible “factor other than sex” under the Equal Pay Act. The Rizo decision is now the federal law across the Ninth Circuit jurisdiction - Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington.

Nevada Mandates Leave and Reasonable Accommodations for Domestic Violence Victims

Beginning January 1, 2018, an employee who has been employed with his/her employer for at least 90 days and is a victim of an act of domestic violence or whose family or household member is a victim of an act of domestic violence, will be entitled to leave and reasonable accommodations.
